Welcome to WorkEikon EHS Software. The following Terms of Use ("Agreement") form a binding legal contract between you ("you" or "User") and WorkEikon ("we," "us," or "WorkEikon"). By purchasing, accessing, or using our services, or by visiting our website, you acknowledge that you have read, understand, and agree to be bound by this Agreement, and comply with all applicable laws regarding your use of our services and website.
You affirm that you possess the legal authority to enter into this Agreement on behalf of yourself or any party you represent.
1.1 "Aggregated Data" refers to data and information related to your use of our services and website, which we use in an aggregated, anonymized format, ensuring it is fully de-identified and does not reveal your identity or that of any individual.
1.2 "Claims" include any form of legal claim, demand, lawsuit, investigation, or proceeding concerning any form of loss.
1.3 "Losses" encompass all types of damages, liabilities, costs, fines, penalties, and expenses, including legal fees.
1.4 "Order" denotes an agreement formalized between you and WorkEikon for our services, documented through an order form or an invoice.
1.5 "Services" covers the content, software, training, support, and any other services WorkEikon provides, as detailed in an Order.
1.6 "Website" refers to WorkEikon's web presence accessible at our designated URL, including all subdomains.
1.7 "WorkEikon Content" encompasses all materials not supplied by you, such as data, templates, programs, and other content we make available through our services or website.
1.8 "Your Content" includes all materials you submit, upload, or create through our services, excluding WorkEikon Content.
2.1 Grant of Rights: Upon purchasing a subscription or being granted access to our services, WorkEikon grants you a non-exclusive, non-transferable, revocable right to use our services, exclusively for internal business purposes and within the limits defined in your Order.
2.2 Third-Party Services: You may access third-party services through our platform. These are provided by external parties and are beyond our control. You acknowledge that WorkEikon is not liable for any third-party services accessed through our platform.
2.3 Account Activity: You are responsible for all activity under your account and must maintain the confidentiality of your login details.
2.4 Authorized Users: Your affiliates, customers, and their employees and contractors may use the services, provided their use complies with this Agreement. You are responsible for their compliance.
2.5 Usage Limitations: If your use exceeds the bounds of your Order, we will collaborate with you to adjust your usage limitations. Failure to adhere to these limitations may result in additional charges or suspension of services.
2.6 Modifications to Services: WorkEikon reserves the right to modify or discontinue any aspect of our services or content at any time.
2.7 Reservation of Rights: All rights not explicitly granted to you are reserved by WorkEikon.
2.8 Use Restrictions: You agree not to misuse the services or allow others to do so.
You agree to pay all fees specified in your Order, along with applicable taxes, as per the payment terms defined therein. Failure to pay may result in suspension or termination of services.
Our Privacy Policy details how we collect and use personal information in relation to our services.
5.1 Your Rights: You retain ownership of Your Content, granting WorkEikon a limited right to use it as necessary to provide services.
5.2 Aggregated Data: WorkEikon owns the rights to Aggregated Data derived from your use of our services.
5.3 WorkEikon's Rights: All intellectual property related to our services and content is owned by WorkEikon.

Our services are provided "as is" without warranties of any kind, express or implied.
WorkEikon's liability to you is limited as described in this section.
You agree to indemnify WorkEikon against all claims and losses related to your use of our services, Your Content, or breach of this Agreement.
